Terms of Service

Effective Date: March 20, 2026

IMPORTANT: THIS IS A LEGALLY BINDING AGREEMENT BETWEEN RABBITHOLE AND YOU.

RabbitHole is an online platform that lets community members create and manage their own webcam, audio, and text chat rooms. These Terms of Service ("Terms") explain how the platform operates, the obligations of room creators, moderators, and participants, and the limits of RabbitHole's responsibility as the service provider. Unless otherwise noted, "RabbitHole," "we," "us," or "our" refers to the RabbitHole service.

1. Acceptance of Terms

By accessing or using RabbitHole, installing any RabbitHole application, or creating a room, you agree to be bound by these Terms, our Privacy Policy, and our Refund & Cancellation Policy. If you do not agree, do not access the service. You must review these Terms periodically because we may update them as described in Section 17.

2. Service Overview

RabbitHole provides communications tools, hosting infrastructure, and community safety controls. We do not pre-screen room activity, continuously monitor live rooms, or act as a publisher of user content. Each room is owned and administrated by community members who are solely responsible for the conduct and content within their rooms. We provide reporting tools and may intervene when legally required or when a violation is brought to our attention.

3. Eligibility, Accounts, and Security

  1. Adults Only. RabbitHole is an adults-only service. You must be at least eighteen (18) years of age to create an account or use the Service. No one under 18 may use RabbitHole.
  2. Age Verification. New account registration requires completing a third-party age verification check powered by Didit. Most users complete a quick selfie check first. If Didit cannot confirm you are 18+ from the selfie alone, you may be asked to verify with a government-issued ID on Didit's systems. RabbitHole receives and stores only the verification pass/fail status, your self-reported date of birth from registration, and a Didit session identifier for audit and support. We do not receive, store, or have access to your selfie, estimated age, document number, ID photo, legal name from your ID, address, or other extracted ID details. Verification failure or confirmation that you are under 18 will prevent account creation.
  3. Age Accuracy. You affirm under penalty of perjury that any profile information you provide is accurate and truthful.
  4. Account Security. You must provide accurate registration information and keep your credentials secure. You are responsible for all activity conducted under your account.
  5. Prohibitions. Sharing accounts or creating multiple accounts to evade enforcement actions is prohibited. Notify [email protected] immediately if you suspect unauthorized use.

4. Community Rooms, Hosts, and Moderators

  1. Room Administration. The creator of a room ("Room Host" or "Room Administrator") is responsible for the management and oversight of their room. While RabbitHole provides the infrastructure, the Room Host is the primary point of control for the content and conduct allowed within their space.
  2. Moderation Responsibilities. Room Hosts select their own moderators. Both Hosts and moderators are required to enforce RabbitHole's Community Guidelines and these Terms within their rooms. This includes using provided tools (kick, ban, mute) to remove users or content that violates our policies or applicable law.
  3. Legal Compliance. Room Hosts must ensure that their rooms do not facilitate illegal activity, including but not limited to the distribution of CSAM, non-consensual intimate imagery, or extremist content. Failure to moderate a room effectively may lead to the suspension of the Room Host's account or the room itself.
  4. Platform Neutrality. RabbitHole is a provider of interactive computer services and generally does not pre-screen or monitor room activity. The legal responsibility for content published in a room rests with the individual user who provided it, but the Room Host is responsible for maintaining an environment that adheres to these Terms.

5. Acceptable Use and Prohibited Conduct

You may not use the service to:

RabbitHole may remove or block content, rooms, or users that violate these rules or applicable law. We may employ automated filters or human review, but we do not promise continuous monitoring.

6. User Submissions and Licenses

  1. Ownership. You retain ownership of the content you submit, stream, or display ("User Submissions"). By using RabbitHole, you grant us a worldwide, non-exclusive, royalty-free, sublicenseable and transferable license to host, transmit, display, reproduce, and distribute that content solely as needed to operate the service, provide support, and comply with legal obligations.
  2. Representations. You represent that you have all necessary rights to the content you share and that it does not violate law or third-party rights.
  3. Room Host License. Room Hosts must ensure they have the rights to any pre-recorded or uploaded media they share and are strictly prohibited from recording, rebroadcasting, or archiving live participant audio, video, or chat. Capturing other users in any format violates these Terms regardless of claimed consent.

7. Safety, Recording, and Assumption of Risk

  1. Assumption of Risk. Understand that you may encounter content or conduct that you perceive as offensive or harmful. You assume the risk of participating in community-created rooms.
  2. Content Capture Disclosure. You acknowledge that if you elect to publish or display images, video, or chat ("Publishing"), other users may be able to capture, reproduce, and/or download such content and redistribute it in undesired or unexpected forms or venues. YOUR PUBLISHING OF SUCH CONTENT IS AT YOUR OWN RISK.
  3. Unauthorized Recording. Agree not to record, capture, screenshot, rebroadcast, or otherwise copy any portion of another participant's experience unless RabbitHole provides a feature that gathers explicit, in-product consent from every participant. Unauthorized recording is grounds for suspension. While we prohibit such behavior, no platform can guarantee perfect compliance—report violations immediately so we can act.
  4. Indemnity. Release RabbitHole from liability for actions or inactions of other users, except to the limited extent required by applicable law.

8. Payments, Digital Items, and Refunds

Purchases of digital goods, prepaid membership passes, or other paid features are processed by third-party payment providers. Billing data is handled under our Privacy Policy. All sales are subject to our Refund & Cancellation Policy, which is incorporated into these Terms.

New PayPal purchases are one-time payments with no automatic renewal. Membership passes are added to your inventory after payment is confirmed; the stated duration starts when activated. Activate, pause or gift eligible passes in the app. Your PayPal receipt may show a shared accessory price label; RabbitHole purchase history identifies the item purchased.

9. Intellectual Property

The RabbitHole name, logos, software, documentation, and original content are our property or the property of our licensors and are protected by copyright, trademark, trade secret, and other laws. You may not copy, modify, distribute, or create derivative works from the service without written permission, except as allowed by law.

10. Takedown Process (Copyright & Other Claims)

We respond to properly formatted copyright notices under the Digital Millennium Copyright Act (DMCA) or other applicable regimes. Send notices to [email protected] with sufficient detail to locate the material. We may forward notices to the affected Room Host or user. Repeat infringers may be removed.

11. Suspension and Termination

We may, at any time and without prior notice, suspend or terminate access to the service (or specific rooms) for any conduct that we determine, in our sole discretion, violates these Terms, creates liability for us, or threatens the integrity of the platform. We reserve the right to deactivate accounts that are inactive for six (6) months or more.

12. Disclaimer of Representations and Warranties

RABBITHOLE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION, ANY REPRESENTATIONS OR WARRANTIES REGARDING CONTENT OR ACCESS TO THE SERVICE OR SOFTWARE, REGARDING TITLE OR NON-INFRINGEMENT, OR REGARDING MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT THE SERVICE WILL MEET YOUR EXPECTATIONS.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL RABBITHOLE, ITS OWNER, AFFILIATES, OR THEIR REPRESENTATIVES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF THE USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO RABBITHOLE IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR (B) USD $50.

14. Indemnification

You agree to defend, indemnify, and hold harmless RABBITHOLE, its owner, affiliates, and representatives from and against any and all claims, losses, liabilities, costs, damages and expenses (including reasonable legal fees) arising from or relating to: (a) your use of the service; (b) your User Submissions; (c) your violation of these Terms; or (d) your violation of any law or third-party right.

15. YouTube API Services

By accessing YouTube content through RabbitHole, you agree to be bound by the YouTube Terms of Service: https://www.youtube.com/t/terms.

16. Governing Law and Venue

These Terms are governed by the federal laws of the United States, without regard to conflict of law principles. For disputes not subject to arbitration, you consent to the jurisdiction of federal courts in the United States. If you operate from another jurisdiction with mandatory consumer protections, you retain the rights afforded by those laws.

17. Changes to the Terms

We may modify these Terms at any time by posting the revised version on our website. Your continued use of the service after the effective date constitutes acceptance of the revised Terms. Material changes will be announced via in-app notice or email at least 15 days before they take effect.

18. Contact Information

For questions about these Terms or to submit legal notices, contact [email protected].
